Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and the Locafy development team ("we", "us", "our") governing your access to and use of the Locafy mobile application ("App").
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms in full. These Terms apply to all users of the App.
App Description
Locafy is a location-based discovery application for Android devices that helps users find nearby:
- Fuel Pumps — petrol and diesel stations
- Hospitals — medical centres and clinics
- Restaurants & Cafes — dining and beverage establishments
The App uses the device's GPS and the Google Places API to retrieve and display location data on an interactive Google Map. It also supports English, Hindi, Gujarati, and Marathi languages and includes advertising via Google AdMob.
Eligibility
By using Locafy, you represent and warrant that:
- You are at least 13 years of age.
- You have the legal capacity to enter into these Terms.
- You are using the App for personal, non-commercial purposes unless expressly permitted by us.
- Your use of the App complies with all applicable local, national, and international laws.
License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:
- Download and install the App on Android devices that you own or control.
- Use the App solely for its intended purpose of locating nearby places.
This licence does not include the right to:
- Sublicense, sell, resell, or transfer the App to any third party.
- Modify, adapt, translate, reverse engineer, decompile, or disassemble the App.
- Create derivative works based on the App.
- Remove any copyright, trademark, or other proprietary notices from the App.
Permitted Use
You may use Locafy for the following lawful purposes:
- ✓Finding nearby fuel pumps, hospitals, and restaurants for personal use.
- ✓Searching locations by typing a city, area, or landmark name in the search bar.
- ✓Using GPS to detect your current location for search purposes.
- ✓Switching the App language to English, Hindi, Gujarati, or Marathi.
- ✓Opening a place result in Google Maps to get directions.
Prohibited Use
You agree not to use the App in any manner that:
- Violates any applicable law or regulation.
- Involves reverse engineering, decompiling, or attempting to extract the source code of the App.
- Scrapes, harvests, or collects data from the App or Google APIs in an automated manner.
- Interferes with or disrupts the integrity or performance of the App or its underlying APIs.
- Attempts to gain unauthorised access to the App, related systems, or networks.
- Uses the App for commercial purposes without our prior written consent.
- Circumvents any access controls, rate limits, or security features of the App or Google APIs.
- Facilitates any fraudulent, abusive, or harmful activities.
Third-Party Services
Locafy relies on the following third-party services to function. Your use of these services within the App is additionally subject to their respective terms:
- Google Maps Platform (Maps SDK, Places API) — governed by the Google Maps Platform Terms of Service.
- Google AdMob — governed by the Google Mobile Ads SDK Terms of Service.
We are not responsible for the availability, accuracy, content, or practices of any third-party service. By using Locafy, you also agree to comply with the applicable terms of these third-party providers.
Accuracy of Information
Place information displayed in Locafy — including names, addresses, operating hours, ratings, and distance — is sourced from the Google Places API and is provided "as is".
Place details, ratings, and open/closed status may change without notice and may differ from real-world conditions. We are not liable for any decisions made based on information displayed in the App.
Advertisements
Locafy is a free app supported by advertising. By using the App, you agree to the display of advertisements served by Google AdMob, which may include:
- Banner ads displayed at the bottom of the screen.
- Interstitial (full-screen) ads shown between searches.
We do not control the specific ads served by AdMob. Ad content is determined by Google's advertising systems based on your device settings and ad preferences. We are not responsible for the content of third-party advertisements.
You may opt out of personalised ads through your device's Google settings as described in our Privacy Policy.
Intellectual Property
All intellectual property rights in and to the App — including but not limited to the name "Locafy", logo, UI design, graphics, source code, and written content — are owned by or licensed to us.
Nothing in these Terms grants you any right, title, or interest in our intellectual property other than the limited licence described in Section 4.
The Google Maps and Google Places content displayed within the App is owned by Google LLC and is subject to Google's Terms of Service. We do not claim ownership of map data or place information.
Disclaimers
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose.
- Warranties that the App will be error-free, uninterrupted, or free of viruses.
- Warranties regarding the accuracy or reliability of place data.
- Warranties that the App will meet your specific requirements.
We do not warrant that defects in the App will be corrected or that the App or the servers that make it available are free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
- Loss of profits, revenue, data, business, or goodwill.
- Damages resulting from inaccurate place information displayed in the App.
- Damages resulting from reliance on the App for emergency or critical services.
- Damages caused by third-party services (Google Maps, Google Places, AdMob).
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the maximum extent permitted by law.
Our total aggregate liability arising out of or relating to your use of the App shall not exceed INR 0 (as the App is provided free of charge).
Indemnification
You agree to defend, indemnify, and hold harmless Locafy and its developers, officers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App.
- Your violation of these Terms.
- Your violation of any applicable law or third-party rights.
- Any content or data you submit through or in connection with the App.
Termination
We reserve the right to terminate or suspend your licence to use the App at any time, without notice and for any reason, including if we believe you have violated these Terms.
Upon termination:
- Your licence to use the App immediately ceases.
- You must uninstall the App from all your devices.
- All provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.
You may terminate your use of the App at any time by uninstalling it from your device.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms (indicated by the "Last Updated" date at the top of this page).
We may notify you of material changes through an in-app notification or by releasing an updated version of the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
It is your responsibility to review these Terms periodically. If you do not agree to the revised Terms, you must discontinue using the App.
